NAME: 12 members of Sumarin Family
 VIOLATIONS: Forceful Eviction of Palestinian family by JNF
The 12-member Palestinian Sumarin family, including five children, a pregnant mother, and a grandfather on dialysis has been ordered to vacate its house in the East Jerusalem neighborhood of Silwan on 28 November 2011. Their house is considered by the authorities as a property of an absentee, and therefore, it was transferred to the hands of the Himanuta company which requested the eviction.
Himnuta, a subsidiary of the Jewish National Fund, has been trying to get the Sumarin family to leave since 1991. Himnuta claims the house where the Sumarins are living actually belongs to it.
In the 1980s and early 1990s, dozens of properties in Silwan were declared absentee properties and sold to the Development Authority. The Development Authority and the Israel Land Administration are required to administer their assets equally without discrimination based on nationality. Conversely, the JNF and Himnuta operate according to a JNF memo that provides that its assets be leased or transferred to the possession of Jews only. In order to bypass the requirement of equality, the authorities in the early 1990s used the JNF and Himnuta to transfer property in Silwan to the settlers.

Dear Mr Robinson
On humanitarian grounds, I urge you to immediately stop Himnuta, owned entirely by your organisation -JNF/KKL, from evicting the twelve members of the Sumarin family, including five children, a pregnant mother, and a grandfather on dialysis, from their house in Silwan in East Jerusalem.
The JNF/KKL took possession of the family home by unfairly exploiting Israel’s Absentee Property Law, and has then pursued a legal case to evict the family.
The eviction may be “legal” according to Israeli law but it is not just, and is a violation of both Jewish and human rights law. The Sumarin family has been living in their home for more than forty years.
 Jewish law goes to great lengths to prevent evictions, especially in cases in which those evicted will end up “abandoned on the street,” in the words of Moses Maimonides.
The apartheid laws being used to evict the Sumarin family are only applied towards Arabs and Palestinians, violating the Jewish tradition’s demand to have one law for all, not to oppress the stranger and not to act eifah v’eifah, with a double standard. International law includes significant protections against displacement.
